California court affirms prisoner's right to werewolf erotica.

After two years of appeals, an inmate at Pelican Bay State Prison won back a werewolf erotica novel that prison guards had taken from him. The decision is a loss for prison censorship but a victory for all inmates with a soft spot for illicit love and interspecies intercourse.
When Andres Martinez ordered a copy of "The Silver Crown," a novel by Mathilde Madden about a werewolf hunter who falls in love with her prey, prison guards searched the book for sex scenes and, finding no shortage, confiscated it. Martinez is a convicted attempted murderer and an associate of the Mexican Mafia prison gang. Guards called the book obscene and likely to incite violence.
Now, in a 30-page decision alternately sterile and steamy, a San Francisco appeals court has ruled that Martinez has a right to the book. The court’s analysis is equal parts 1st Amendment commentary and dirty book report. (“The sex is sometimes rough but always consensual,” Justice James Richman wrote. “Women are portrayed as frequently aggressive, always willing, and seemingly insatiable. Men are portrayed as frequently demanding, always ready, and seemingly inexhaustible.”)
Though the three-judge panel deemed the book’s characters “perhaps less than Shakespearean,” it said the novel nonetheless possesses “serious literary value.” That’s a standard the Supreme Court set for protected speech in 1973, ruling that a work can be labeled obscene only if it lacks literary, political or scientific value. Pelican Bay’s rules violate that standard in outlawing all publications that describe sex.
It’s troubling, though not surprising, that a prison warden would let werewolf sex scare him out of enabling an inmate’s education (and, you know, honoring an inmate’s right to read). But what’s more disconcerting is the attorney general’s argument, struck down in the ruling, that prisons should be allowed to expand without oversight the definition of obscenity beyond what’s authorized by law. The attorney general also argued that only prison guards are qualified to decide what constitutes a threat to prison safety. In the contest between convenience for prison guards and prisoners’ rights, convenience wins in a rout.
Censoring furry ménage à trois is actually only the latest of California’s restrictions on sex-related material in prisons. California banned pornographic magazines in 2002, arguing that inmates were using them to create a hostile work environment for female guards. (Fair, but why not penalize the hostile behavior instead of the words and pictures that may or may not promote that behavior? Some studies, like this one by Anthony D’Amato at Northwestern, argue that porn may curb sexual aggression.) California even has an infraction called “Intentionally Sustained Masturbation without Exposure” for inmates who get caught masturbating under their covers.
Lawyers warned that California’s 2002 restriction on porn portended a more expansive book ban. "This is like banning 'Catcher in the Rye' because it might induce a prisoner to say something disrespectful," David Fathi, an attorney with the ACLU's National Prison Project, told the L.A. Times of the porn ban. "They're using this as a backdoor way to ban publications that don't cause any risk to prison security.” The real goal wasn’t safety but control over prisoners’ access to ideas.
He was right. Fortunately, Andres Martinez stood up for his constitutionally guaranteed right to paranormal love. The Mexican Mafia prison gang’s contingent of "Twilight" fans surely thanks him.
